Personal Information Protection Policy

At THE PACK CORPORATION, we shall properly handle all personal information dealt with in the course of our business in accordance with applicable laws, regulations and other standards pertaining to the protection of personal information, with the awareness that its protection is our corporate social responsibility.
As described below, we have established our policy on personal information protection, which we are committed to implementing across our organization with constant review and improvement, aiming to protect personal information in a thoroughgoing manner.

  • We shall observe applicable laws and regulations on personal information protection, including the Act on the Protection of Personal Information, the duties set forth in the guidelines issued by the cabinet minister in charge, and other relevant standards; and we shall abide by our policy.
  • We shall specify our purpose of collecting personal information within our legitimate scope of operations and obtain, use and provide such information in a proper and ethical manner to the extent necessary to achieve the purpose.
  • We shall strive to keep our retained personal information accurate and updated to the extent necessary to fulfill our purpose of use, and shall take necessary and appropriate security control measures against unauthorized access, leakage, loss or falsification.
  • To implement our policy on personal information protection, we shall establish our internal systems and implement in-house training programs with constant maintenance and improvement.

Guidelines for Personal Information Handling

Recognizing the importance of personal information in our advanced information and communications society, we have established “THE PACK CORPORATION. Personal Information Protection Policy,” which we have been making concerted efforts to implement.
Specific details regarding our personal information handling procedures are explained below.

Basic Rules for Handling Personal Information

We shall specify our purpose of use of personal information as concretely as possible and handle personal information within the scope of the specified purpose of use, except when we obtain the prior consent of the person concerned or when exception rules apply by law.

Acquisition and Purpose of Use

We shall acquire personal information in a proper and ethical manner.

  • When we acquire a person’s personal information, we shall publicly announce beforehand the purpose of use on our official website or by other means, or notify the person of the purpose of use, or publicly announce the purpose of use immediately after the acquisition, except in cases where exception rules apply by law.
  • When we directly acquire personal information from a person, we shall expressly show the person the purpose of use in advance. However, with regard to information on business cards, telephone numbers and email addresses exchanged in our daily business operations; information contained in order sheets/quotations; information we obtain in dealing with inquiries and complaints to our company; and information we obtain from a person in confirming the person’s identity, we shall acquire and use personal information without expressly showing the specific purpose of use in each instance solely in the following cases where the purpose of use is clear from the circumstances of acquisition:
    1. Use for the purpose of order arrangements, communication, mailing and transportation in daily business operations
    2. Use for the purpose of providing information about our products, services and exhibitions
    3. Use for the business operations of our company and group companies
    4. Use for the purpose of confirming a person’s identity and sending responses to or contacting the person about his or her inquiries
    5. Use for other purposes which are clear from the circumstances of acquisition
  • When we conduct our recruiting activities, we shall use an applicant’s personal information, obtained directly from the applicant and/or through our business partner Mainichi Recruiting Navi, only for purposes related to our recruiting activities, which include using it as reference material in making employment decisions as well as contacting and sending notices to the applicant. However, we shall also use the personal information of an applicant to whom we have made a job offer as reference material for personnel/labor management after the applicant has joined the company.
  • When we acquire a person’s personal information from public information sources, such as telephone directories, we shall limit the scope of personal information to be acquired to the minimum level necessary to provide the person with information on our products and services by mail, delivery service, or telephone. When the person requests that we correct or delete the personal information, we shall promptly deal with such a request within the scope reasonable and appropriate to our business operations.
  • When we are entrusted with operations, including the handling of personal information, we shall use the personal information only for the trustor’s purpose of use or the purpose(s) specifically designated by the trustor. Example: When we are entrusted with dispatching goods and direct mail, we shall use personal information only for performing the tasks related to dispatching the goods and direct mail and confirming their arrival.
  • The purpose of use of personal information contained in our shareholder registry shall be as follows:
    1. To exercise rights and perform obligations under the Commercial Code
    2. To provide, as an issuing company, various shareholder benefits to shareholders
    3. To implement various measures to facilitate smooth relationships between the company and shareholders, especially from the viewpoint of an association and its members
    4. To be used for the management of shareholders, including creating a shareholder database in accordance with the standards set forth by laws and regulations
  • We shall, as a general rule, announce our purpose of use in these guidelines or the “Publication of Personal Information” section on our website.

Personal Data Management

We shall keep the personal data we handle in the course of our business accurate and updated within the scope of purpose of use, and take necessary and appropriate measures for security control.

  • We shall take reasonable and appropriate security measures against unauthorized access and computer viruses to prevent the loss, destruction, falsification, or leakage of personal information.
  • When we entrust to an entity the preparation/processing of personal data and the handling of personal information for the operation within the scope of purpose of use, we shall select an appropriate trustee, conclude a contract necessary for personal information protection, and exercise appropriate supervision over the trustee.

Provision to Third Parties

We shall not provide a person’s personal data to a third party without obtaining the person’s prior consent, unless otherwise provided by law. However, none of the following entities shall fall under the category of a third party:

  • Trustees, when the preparation, processing, or management of personal data is entrusted
  • Entrusted manufacturers or transportation companies, when the handling of operations involving personal information is entrusted within the scope of the purpose of use expressly shown, notified, publicized or consented to
  • Joint users of personal data, when personal data is used jointly [when we notify the persons concerned or put on our website beforehand the joint use, joint users, purpose of use, data items and responsible administrator(s)]
  • The following companies which belong to our corporate group:

Purpose of use: To provide information on new products, including clothing, apparel accessories and uniforms, related services and exhibitions; and to perform intra-group business communication and sales promotion activities
Personal data items: Name, address, telephone number, fax number, email address, company name, department name and job title

Keihin Tokushu Printing Corp.

Purpose of use: To provide information on printing and other business operations, and to perform intra-group business communication and sales promotion activities
Personal data items: Name, address, telephone number, fax number, email address, company name, department name and job title

NIKKO PRINT CORPORATION

Purpose of use: To provide information on printing and other business operations, and to perform intra-group business communication and sales promotion activities
Personal data items: Name, address, telephone number, fax number, email address, company name, department name and job title

PACK TAKEYAMA CO.,LTD

Purpose of use: To provide information on business operations related to our products, including packages; to provide information on related services and exhibitions; and to perform intra-group business communication and sales promotion activities
Personal data items: Name, address, telephone number, fax number, email address, company name, department name and job title

The Pack America Corp.

Purpose of use: To provide information on business operations related to our products, including packages; to provide information on related services and exhibitions; and to perform intra-group business communication and sales promotion activities
Personal data items: Name, address, telephone number, fax number, email address, company name, department name and job title

The Pack (Shanghai) Corporation

Purpose of use: To provide information on business operations related to our products, including packages; to provide information on related services and exhibitions; and to perform intra-group business communication and sales promotion activities
Personal data items: Name, address, telephone number, fax number, email address, company name, department name and job title

The Pack (Changshu) Corporation

Purpose of use: To provide information on business operations related to our products, including packages; to provide information on related services and exhibitions; and to perform intra-group business communication and sales promotion activities

We shall use personal information provided by the above seven companies within the scope of the following purpose and data items:

Purpose of use: To provide information on business operations related to our products, including packages; to provide information on related services and exhibitions; and to perform intra-group business communication and sales promotion activities
Personal data items: Name, address, telephone number, fax number, email address, company name, department name and job title

Response to a “Request for Disclosure, etc.”

When we receive a request from a person or the person’s representative for disclosure, correction, deletion, etc. of our retained personal data, we shall respond without delay to such a request to a reasonable and appropriate extent, after confirming that the person is the subject of the personal information.

  • With regard to a disclosure request, we shall make the disclosure in writing or by the means to which the person or his or her representative consents.
  • When we are requested, as a result of disclosure, to correct, add, or delete the content of the retained personal data on the ground that the data is incorrect, we shall respond to such a request within the scope of our intended use after verifying the fact.
  • When we are requested to stop the use of or erase the retained personal data on the ground of improper acquisition of personal information and/or use of personal information for unintended purposes, we shall make a factual investigation and promptly respond to such a request.
  • When it is found that we have provided the retained personal data to a third party without following proper procedures, we shall suspend provision of the data without delay.

How to make a “Request for Disclosure, etc.”

When you make a “Request for Disclosure, etc.,” please fill out a designated request form and send it by mail, with the required documents attached, to the Personal Information Management Desk indicated below. Please note that in principle we cannot receive any “Request for Disclosure, etc.” by telephone/fax or at our office in person. We would appreciate it if you could write the phrase “Request for Disclosure, etc. Enclosed” in red on the envelope.

Request Form

Please click here to download a “Request for Disclosure, etc.” form, then fill out the form and send it by mail to our Personal Information Management Desk with the following documents enclosed to confirm your identity. To print out a request form, you need Adobe Acrobat Reader. You can download the free software from here if you do not have it.
* If you are unable to download and/or print out a request form in the way stated above, please send an envelope by mail to our Personal Information Management Desk indicated below, writing the phrase “Send a Request for Disclosure, etc. Form” on the outside of the envelope and enclosing a return envelope with an 80-yen stamp affixed. We will send you a requested form by return mail.

Necessary documents other than a request form

The following documents are required to confirm your identity or the identity of your representative if your representative makes a request on your behalf.

If you make a “Request for Disclosure, etc.” in person:
A copy of an official identification document, such as a driver’s license, passport, or basic resident registration card, is required. (A health insurance certificate, national pension booklet, employee pension booklet, or foreign resident registration card is acceptable.)
If your representative makes a “Request for Disclosure, etc.,”
in addition to your identification document above, the following documents are required:

a. In the case of a legal representative

  • A document to confirm that the requestor is your legal representative
    (A copy of a family register or, in the case of a person with parental authority, a copy of an insurance certificate in which you are indicated as a dependent, etc.)
  • A document to verify the identity of the legal representative
    (A copy of an official identification document such as a driver’s license or passport)

b. In the case of an appointed representative

  • A letter of proxy signed and sealed by you and your seal registration certificate
  • A document to confirm that the requestor is your appointed representative
    (A copy of an official identification document such as a driver’s license or a passport)

Commission fee for a “Request for Disclosure, etc.”

If you request “disclosure” or “notice of purpose of use” of retained personal information in your “Request for Disclosure, etc.” form, we will charge you a commission fee of 500 yen per each request. Please enclose postage stamps or a postal money order for 500 yen with your request form and other documents.

* If no postage stamps or money order are enclosed for the commission fee, or if the amount is insufficient, we will notify you to such effect. However, if you fail to make a necessary payment within a week after our notification, your request will be disregarded.
* Even if we are unable to comply with your request for disclosure etc., we will not refund the commission fee you paid.
* No commission fee will be charged, except in the case of “disclosure” or “notice of purpose of use.”

Purpose of Use of Personal Information acquired pertaining to a “Request for Disclosure, etc.”

We will use the personal information we acquire from a request form and required documents concerning a “Request for Disclosure, etc.” within the scope necessary to respond to the request for disclosure, etc.

Non-disclosure

Please note that depending on the content of your request, we will not comply with your request for disclosure in the following cases. We will, however, notify you to that effect with reasons for non-disclosure.

  • If the request form and/or required documents submitted are inadequate
  • If information stated about you in the request form and information in the required documents are inconsistent, causing difficulty in confirming your identity
  • If there is no retained personal data that matches the description in your request form and required documents submitted
  • If we are unable to confirm the authority of representation granted to your representative or the identity of your representative
  • If disclosure turns out to be in violation of laws and regulations
  • If disclosure may harm the life, body, property, or other rights and interests of you or a third party
  • If disclosure may seriously impede the proper execution of our business

Acceptance of Complaints

Complaints about our protection of personal information and handling procedures will be accepted at the Personal Information Management Desk.

Internal Systems

We will develop the following internal systems to implement our policy on personal information protection.

  • We will appoint a personal information protection manager and multiple administrators to implement proper management of personal information.
  • To ensure proper handling of personal information in our daily operations, we will implement education/training programs regarding the protection and proper management of personal information for our board members, employees and other persons concerned.
  • We will come up with compliance programs for personal information protection, which will be put into practice by our board members, employees and other persons concerned, with constant maintenance and improvement.

Definition of terms

Definition of the terms used in the above explanation is as follows:

Personal information
Information about a living individual that can be used to identify the specific individual
Personal data
Personal information constituting a personal information database (a collection of information containing personal information, some of which is systematically arranged in such a way that specific personal information can be retrieved by a personal computer, etc. and some of which is designated by a cabinet order as being systematically arranged in such a way that specific personal information can be easily retrieved)
Retained personal data
Personal data over which we have the authority to disclose, correct, add or delete the content; suspend its use; erase; or suspend its provision to third parties. We shall not erase the data within six months of acquisition. However, data specified by a cabinet order as being detrimental to the public or other interests if its presence or absence is known is excluded.
Person
A specific individual identified by the personal information.
